Abstract
The chapter discusses the impact of the rules on physician-patient privilege on the legitimacy of the International Criminal Court (ICC). Section 21.1 introduces the regulation of patients' right to privacy. Section 21.3 explores the impact of the specific reference to physician-patient privilege on the interpretation of the defendant's right to privacy within the ICC framework. Section 21.4 suggests that a broader consideration of the views of the physicians involved in the proceedings could improve the reasoning in decisions that balance the confidentiality of medical information and the transparency of the proceedings, increasing the perceived fairness of the proceedings and the overall legitimacy of the ICC.
