Abstract

This article reviews the Supreme Court decision in Volcafe Ltd v Compania Sud Americana De Vapores SA [2018] UKSC 61, which clarified who has the burden of proof under the Hague Rules where goods arrive damaged. The Supreme Court showed that it is the carrier who has the burden to explain and prove why the goods were damaged during the voyage.
