Abstract
Comments on the ECtHR decision in Khlaifia v Italy (16483/12) on the human rights obligations of contracting states toward migrants in the context of mass migration crises, particularly the status of holding measures, the necessity for a legal basis and judicial supervision of detention, the right to individual interviews and the migrants' duty to state any reason why they should not be returned. Highlights the dissenting opinions expressed.
