Abstract

Assesses the ECtHR judgment in British Gurkha Welfare Society v United Kingdom (44818/11) on whether the lower UK pension entitlements for Gurkha soldiers who retired or served before 1 July 1997, when a new regime was introduced to allow soldiers to transfer from the Gurkha Pension Scheme to the Armed Forces Pensions Scheme, amounted to unjustifiable discrimination on the basis of nationality, race and age.
