Abstract

This paper will consider the issues that are faced by those considering the development of a globally accepted substantive environmental right.

It considers the use of the Westphalian system of public international law to attempt to resolve problems facing the international community and whether human rights in practice are ultimately an appropriate response to environmental challenges.
